Where do you apply for a DE  Marriage License?

Most Delaware Beach Brides get their license from the Sussex County Clerk in Georgetown. The phone number is 302-855-7700. The fee is $50 for DE residents and $100 if you are out of state.  Couples may apply in person or online.  If you apply online, you still have to pick up the license in person but it may save you some time.  Both applicants must be there and have government issued photo IDs to receive their license.  If it is not the first wedding for either applicant, an original decree of divorce or death certificate will be required.  There is a 24 hour window from the time you receive your Delaware marriage license until you can use it.

What do we do with the Marriage License?

You should receive a white folder with three copies of the Marriage License inside.  Delaware requires two witnesses and the Wedding Officiant to sign all three copies of the license.

 

  1.   The first copy is to be kept by the couple that was married
  2.   The second copy is to retained by the presiding officiant
  3.   The third copy is to be returned in a timely manner to the court

 

Each folder should also have an application for a Certified Copy of the Marriage License.  This is the document needed to apply for a legal name change.  The fee for a certified copy as of January 2021 is $25.

 

Who can Officiate a Wedding in Delaware?

Any ordained Minister that registers with the state may legally Officiate a Wedding in Delaware.  A Certificate of Ordination may be required to validate the marriage. The Officiant is expected to confirm the witness signatures and complete the paperwork in an orderly fashion. The Marriage License must be returned to the court within 15 days or a fee may be imposed.  Traditional or Beach Wedding Vows are up to the individuals participating in the ceremony.
